Acceptance of Terms

These Terms & Conditions ("Terms") govern your access to and use of the SaaS web app provided by ownerly.app ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Eligibility and User Accounts

The Service is intended for individual users in the United States who are at least 18 years old. You are responsible for maintaining the confidentiality of your login credentials (including your Google account) and for all activities under your account.

Use of the Service

You may use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations.
• Attempt to gain unauthorized access to the Service or related systems.
• Interfere with or disrupt the operation of the Service, including via automated scripts or scraping.
• Upload or share content that is unlawful, offensive, or infringes third-party rights.

Subscriptions, Fees, and Free Use

The Service may be offered under both free and paid subscription plans. We may change subscription pricing, features, or plans from time to time; any changes will generally apply going forward and may be communicated through the Service or by email.

Payments and Billing

Paid subscriptions are billed and processed through Stripe, our third-party payment processor. By providing payment details, you authorize us and Stripe to charge applicable subscription fees, taxes, and other charges associated with your plan.

User Content and Images

You may upload content such as images of your items in connection with your account ("User Content"). You retain ownership of your User Content but grant us a limited license to store and process it solely for the purpose of operating and improving the Service for you. User-uploaded images are intended to be accessible only to you within your account and are not made publicly available by default.

Intellectual Property

The Service, including its software, design, and content (excluding User Content), is owned by ownerly.app or its licensors and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or internal business use, subject to these Terms.

Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Service, you acknowledge that you have read and understood the Privacy Policy.

Disclaimers

Limitation of Liability

To the fullest extent permitted by law, ownerly.app and its owners, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your use of the Service. Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you have paid to us for the Service in the twelve months preceding the claim, or, if you use the Service for free, zero dollars.

Termination

You may stop using the Service at any time and may request deletion of your account. We may suspend or terminate your access to the Service if you violate these Terms or if we discontinue the Service, with or without notice as permitted by law.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Indiana, United States, without regard to its conflict of laws rules. Any disputes arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Indiana, and you consent to their jurisdiction.

Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and may provide additional notice (for example, via the Service or email).
